RESOLUTION 04-12
A RESOLUTION APPROVING VARIANCES
FOR A THIRD MONUMENT SIGN FOR DENNIS TROOIEN
OF DS OF CENTRE POINTE (GNB)
AT 1101 CENTRE POINTE CURVE
WHEREAS, Dennis Trooien of DS of Centre Pointe (GNB) has applied for a
variances for a monument sign at 1101 Centre Pointe Curve (Lot 4, Block 2 Yorkton
Centre Pointe South) as proposed in Planning Case #04-01; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on January 27, 2004; and
WHEREAS, The Planning Commission voted 3-2 (with one Commissioner
excused) to recommend that the Council approve the variances for a third monument
sign;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the variances for a third monument sign at 1101 Centre
Pointe Curve as proposed in Planning Case #04-01 are hereby approved on the following
conditions:
I The existing monument sign on Lot 4 Block 2 Yorkton Centre Pointe shall be
removed prior to issuance of a building permit for the new sign on the same
lot.
2. The new sign shall be no greater than 25 feet in height.
3. The base materials shall reflect the stone/decorative concrete block utilized in
the other signage on the site.
4. The sign shall be located at least 30 feet from the street right of way, in
conformance with sign ordinance regulations-.
5. If and when Lot 4, Block 2 Yorkton Centre Pointe is developed with a
principal structure, the lot shall be subdivided and the narrow "neck" of the
parcel with this sign shall be added to the parcel to the south with the existing
"GNB" building to eliminate the off-site sign condition.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that the variances for a third monument sign at 1101 Centre Pointe Curve as
proposed in Planning Case #04-01 are hereby approved based on the following
considerations:
1. These variances are necessary in order to put the property to reasonable use. The
request for variances for a third monument sign is appropriate due to the odd
configuration of the lot, the need for identification on Highway 110 and the size
of the property and the building.
2. The odd shape of the lot is a unique circumstance pertaining to the property not
caused by the owner, but by the dedication of right-of-way for Centre Pointe
Curve after the existing sign was erected.
3. The variances requested will not alter the essential character of the
neighborhood.
4. The variances will improve an existing non-conforming situation be replacing
the existing sign with a new sign that meets the appropriate front-yard setback.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that the variances for a third monument sign at 1101 Centre Pointe Curve as
proposed in Planning Case #04-01 would not have an adverse impact on the health,
safety, and general welfare of the citizens of the community and the surrounding land,
and would not be adverse to the general purpose and intent of the Zoning Ordinance.
