Res 2004- 13 Approving CUP @ 1031 MH RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA 1 1 1 1 WHEREAS, Tim Mcllwain, on behalf of Patterson Dental, has applied for a PUD Amendment at 1031 Mendota Heights Road [Lots 1 & 2, Block 1, IOS Plaza Addition, Dakota County, Minnesota] as proposed in Planning Case #04 -03; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on January 27, 2004; and WHEREAS, The Planning Commission voted 4 -2 (with one Commissioner excused) to recommend that the Council approve the CUP for a PUD Amendment as presented to the Planning Commission on the evening of January 27, 2004 and as shown in Planning Case #04 -03 under certain conditions. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a PUD Amendment at 1031 Mendota Heights Road as proposed in Planning Case #04 -03 is hereby approved on the following conditions: 1. The City Engineer shall review and approve all plans, including but not limited to grading and fill information. 2. The applicant shall replat the property into a single parcel. 3. The applicant shall provide additional maple and birch species throughout the eastern side of the site. 4. The applicant shall provide information on any exterior lighting of the building and parking area for Council review 5. The applicant shall provide information on any proposed additional signage for Council review. BE IT FURTHER RESOLVED that the PUD Amendment at 1031 Mendota Heights Road as proposed in Planning Case #04 -03 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
