Res 2004- 16 Renewing CUP to Linder's for Mendota PlazaCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04-16 A RESOLUTION RENEWING A CONDITIONAL USE PERMIT TO LINDER'S GREENHOUSES TO OPERATE A TEMPORARY SEASONAL GARDEN CENTER IN THE PARKING LOT OF MENDOTA PLAZA UNDER CERTAIN CONDITIONS WHEREAS, Mr. Peter Linder applied for and was granted a Conditional Use Permit for Linder's Greenhouses to operate a temporary seasonal garden center in the parking lot of Mendota Plaza for the 2000 season, as proposed on plans on file in Planning Case File No. 00-06; and WHEREAS, Linder's Greenhouses faithfully complied with all of the Conditions of the Conditional Use Permit, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit renewal for Linder's Greenhouses to operate a temporary seasonal garden center in the parking lot of Mendota Plaza, as proposed on plans on file in Planning Case File No. 00-06 is hereby approved on the following conditions: 1. The operator of the temporary garden center is Linder's Greenhouses, Garden Centers and Flower Marts. 2. The temporary garden center is located in the northeast comer of the Mendota Plaza Shopping Center parking lot. 3. The dates of operation are from March 15, 2004 to July 15, 2004. 4. The size of the total area used for the temporary garden center is 4,752 square feet. 5. Hours of operation are 8:00 a.m. to 8:00 p.m. daily. 6. All signs must conform to the sign regulations contained in the Zoning Ordinance; the necessary permits must be applied for and issued. 7. Fencing consists of a 4-foot high patio fence around three sides of the garden center. 8. Trash is to be removed from the site daily by the operator. 9. Any necessary utilities such as electricity and water are supplied by the Mendota Plaza Shopping Center owners. 10. Everything is removed from the site by the final date of the Conditional Use Permit. 11. Linder's Greenhouses shall submit a report to the City no later than September 1, 2004 describing the results of their season including all aspects of their operation, but at a minimum detailing any safety or security problems. Staff shall analyze the report, add their comments and place it on the Council agenda for discussion. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Conditional Use Permit renewal for Linder's Greenhouses to operate a temporary seasonal garden center in the parking lot of Mendota Plaza, as proposed on plans on file in Planning Case File No. 00-06 would have not an adverse impact on the health, safety and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
