Res 2004- 21 Approving Variance @ 1924 Walsh LnCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04 -21 A RESOLUTION APPROVING A FRONT YARD SETBACK VARIANCE FOR A GARAGE ADDITION AT 1924 WALSH LANE WHEREAS, Patrick Donohue has applied for a Front Yard Setback Variance for a Garage Addition at 1924 Walsh Lane (Lot 7, Wagenknecht's Addition, Dakota County, Minnesota, PIN - 27- 83300 - 070 -00) as proposed in Planning Case #04 -07; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on March 23, 2004; and WHEREAS, The Planning Commission voted 5 -0 (with two Commissioners excused) to recommend that the Council approve the Front Yard Setback Variance for a Garage Addition as presented to the Planning Commission on the evening of March 23, 2004 and as shown in Planning Case #04 -07. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Front Yard Setback Variance for a Garage Addition for 1924 Walsh Lane as proposed in Planning Case #04 -07 is hereby approved based on the following considerations: 1. This variance is necessary in order to put the property to reasonable use. The request for encroachment within the additional front yard setback area due to the "string rule" is appropriate due to the position and orientation of the house to the immediate south of the applicant's house. 2. The position and orientation of the house to the immediate south of the applicant's house constitutes a unique circumstance pertaining to the applicant's property not caused by the owner, by severely restricting potential expansion of the applicant's house toward the street. 3. The variance requested will not alter the essential character of the neighborhood. BE IT FURTHER RESOLVED that the Front Yard Setback Variance for an Garage Addition for 1924 Walsh Lane as proposed in Planning Case #04 -07 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
