RESOLUTION NO. 04 - 25
RESOLUTION ACCEPTING ENGINEER'S REPORT, ORDERING OF IMPROVEMENT
PROJECT, AND PREPARATION OF PLANS AND SPECIFICATIONS
FOR STREET RECONSTRUCTION IMPROVEMENTS ON SOMERSET COURT TO
SERVE PROPERTIES IN THE SOMERSET WEST REPLAT AND SURROUNDING AREAS
(IMPROVEMENT NO. 2004, PROJECT NO. 3)
WHEREAS, pursuant to Resolution 03 -98, the City Council, on October 7, 2003, ordered a
feasibility report to be prepared by the City Engineer with reference to the improvement of Somerset
Court; and
WHEREAS, the City Engineer has submitted a report to the City Council with respect to the
Somerset Court improvements which include storm sewer, aggregate base, concrete curb and gutter,
bituminous surfacing and appurtenant work; and
WHEREAS, in said report the City Engineer reported that the proposed improvements and
construction thereof are desirable and necessary, technically and economically feasible, cost effective,
and further reported on the estimated cost of the proposed improvements; and
WHEREAS, a petition signed by owners of all real owners of property affected requesting the
improvement of Somerset Court, dated April 19, 2004, has been received by the City Council; and
WHEREAS, per Minnesota Statutes Chapter 429, when the petition is signed by owners of all
real property affected by this project, no public hearing is required.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
Mendota Heights, Minnesota as follows:
1. The City Council hereby accepts the Feasibility Report as submitted.
2. The Council will consider the improvement of such streets and areas in accordance with
the report and the assessment of property as described in the report for all or a portion of
the cost of the improvements pursuant to Minnesota Statutes Chapter 429 at an
estimated total cost of the improvements of $33,000.
3. The petition requesting the improvement of Somerset Court filed with the Council on
May 4, 2004, is hereby declared to be signed by owners of all real property affected
thereby. This declaration is made in conformity to Minnesota Statutes 429.035.
4. That it is advisable, economically feasible, expedient, and necessary that the City of
Mendota Heights construct the above described improvements, and it is hereby ordered
that said improvements be made.
5. That the City Engineer be and is hereby authorized and directed to prepare plans and
specifications for said improvement.
6. That said improvement shall hereafter be known and designated as Improvement
No. 2004, Project No. 3.
