RESOLUTION 04 -29
A RESOLUTION APPROVING
A CONDITIONAL USE PERMIT AND WETLANDS PERMIT
FOR A FENCE AT 661 CHEYENNE LANE
WHEREAS, Mr. Scott Landsman has applied for a Conditional Use Permit and
Wetlands Permit for a Fence at 661 Cheyenne Lane (Lot 1, Block 1, Delaware Crossing, Dakota
County, Minnesota, PIN = 27- 19850- 010 -01) as proposed in Planning Case #04 -08; and
WHEREAS, The Planning Commission held a public hearing on this application at their
regular meeting on April 27, 2004; and
WHEREAS, The Planning Commission voted to recommend that the Council approve
the Conditional Use Permit and Wetlands Permit for a Fence as presented to the Planning
Commission on the evening of April 27, 2004 and as shown in Planning Case #04 -08 under
certain conditions,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit and Wetlands Permit for a Fence for 661
Cheyenne Lane as proposed in Planning Case #04 -08 is hereby approved under the following
conditions:
1. The landscape outside the fence shall be maintained in natural materials.
2. The applicant shall provide a landscape plan to the City Staff for their review and
approval. This landscape plan shall include year -round vegetation along the Huber Drive
side of the fence that shall screen the view of the Huber Drive portion of the fence from
Huber Drive.
3. The above landscape plan shall be implemented by September 1, 2005.
BE IT FURTHER RESOLVED that the Conditional Use Permit and Wetlands Permit
for an Fence for 661 Cheyenne Lane as proposed in Planning Case #04 -08 under the above
conditions would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the surrounding land, and would not be adverse to the general
purpose and intent of the Zoning Ordinance.
