Res 2004- 34 Approving CUP and Variance @ 1111 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04-34 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND A VARIANCE FOR AN 864 SQUARE FOOT DETACHED GARAGE AT 1111 DODD ROAD WHEREAS, Mr. Dennis Forsberg has applied for a Conditional Use Permit and Variance for a detached garage at 1111 Dodd Road (Lots 26, 27, and 28, John H. Morrison Addition PIN = 27-49200-280-02) as proposed in Planning Case #04-12; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on May 25, 2004; and NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that a Conditional Use Permit and Variance for an 864 foot detached garage for 1111 Dodd Road as proposed in Planning Case #04-12 is hereby approved on the following conditions: 1. The existing detached garage shall be entirely removed from the property. 2. The hard surface under the existing garage and "lean-to" attachments shall be reduced to an area of 12 feet by 20 feet. 3. The new detached garage shall be no greater than 864 square feet in size. No "lean-tos", "wings", or other attachments shall be added to the new garage. 4. The new detached garage shall match the existing house in exterior color and materials. 5. The existing playhouse in the rear yard shall be removed completely. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that a Variance for an 864 square foot detached garage detached garage for 1111 Dodd Road as proposed in Planning Case #04-12 is hereby approved based on the following considerations: 1. The variance is necessary in order to put the property to reasonable use. 2. There are imique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the variance. The applicant is not able to reasonably build an attached garage of sufficient size, because of the safety need to have some type of turnaround for pulling out onto Dodd Road. 3. The original layout of the home was not designed to accommodate an attached garage. 4. The existing home site currently sits on the combination of three separate lots. 5. Because of heavy traffic on Dodd Road, a backup and turnaround is necessary for safe entry onto the road. 6. The variance will not alter the essential character of the neighborhood. The requested variance is diminimus (less than 15% of the allowed size for a detached garage), the lot is unusually large, and the new garage will be sufficiently screened from the neighbors. 7. The larger garage will facilitate clean -up of the yard and provide for improved aesthetics of the neighborhood. 8. The replacement of the existing garage with the new garage will result in a net reduction of impervious surface on the property and thus reduce the amount of stormwater that must be managed by the municipal stormwater management system. BE IT FURTHER RESOLVED that the Conditional Use Permit and Variance for an 864 square foot detached garage for 1111 Dodd Road as proposed in Planning Case #04 -12 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
