RESOLUTION 04-50
A RESOLUTION APPROVING
A VARIANCE FOR DRIVEWAY WIDTH
AT 1933 CROWN POINT DRIVE
WHEREAS, Mr. William St. Martin has applied for a Variance for Driveway
Width at 1933 Crown Point Drive (Lot 2 Block 2 Crown Point Addition) as proposed in
Planning Case #04-25; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on July 27, 2004; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Variance for Driveway Width as presented to the Planning Commission on
the evening of July 27, 2004 and as shown in Planning Case #04-25,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a Variance for Driveway Width for 1933 Crown Point
Drive as proposed in Planning Case #04-25 is hereby approved on the following
condition:
1. The applicant shall install landscaping on the west side of the driveway and
garage consisting of shrubs or other appropriate planting no more than three feet
in height to soften the view of the expanded garage and driveway.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this Variance for Driveway Width for 1933 Crown Point Drive as proposed
in Planning Case #04-25 is hereby approved under the above condition based on the
following considerations:
1. The variance is necessary in order to put the property to reasonable use such that the
parts of the property intended for vehicle storage can be properly accessed in a safe
and reasonable manner.
2. There are unique circumstances pertaining to the applicant's property not caused by
the owner including the odd shape of the lot, curvature of the road near the driveway
and topographic features that create a sufficient hardship to justify the variance.
3. The variance will not alter the essential character of the neighborhood because the
views, massing and position of the structure will not change appreciably.
BE IT FURTHER RESOLVED that the Variance for Driveway Width for 1933
Crown Point Drive as proposed in Planning Case #04-25 under the above condition
would not have an adverse impact on the health, safety, and general welfare of the
citizens of the community and the s-LuTounding land, and would not be adverse to the
general purpose and intent of the Zoning Ordinance.
