RESOLUTION 04-67
A RESOLUTION APPROVING
A 20-FOOT FRONT-YARD SETBACK VARIANCE
FOR A NON-ILLUMINATED MONUMENT SIGN
AT 1340 MENDOTA HEIGHTS ROAD
WHEREAS, Mr. Steve Hirtz has applied for a Front-Yard Setback Variance for a
Non-Illuminated Monument Sign at 1340 Mendota Heights Road [Lots 1, 2, and 3 Block
I Mendota Heights Business Center, and Lots 1, 2, and 3 Mendota Heights Business
Center 2'd Addition, PIN#s=27-48251-020-01 and 27-48251-030-01] as proposed in
Planning Case #04-35; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on August 24, 2004; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve a 20-Foot Front-Yard Setback Variance for a Non-Illuminated Monument Sign
as presented to the Planning Commission on the evening of August 24, 2004 and as
shown in Planning Case #04-35,
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that a 20-Foot Front-Yard Setback Variance for a Non-
Illuminated Monument Sign for 1340 Mendota Heights Road as proposed in Planning
Case #04-35 is hereby approved.
BE IT FURTHER RESOLVED by the City Council of the City of Mendota
Heights that this 20-Foot Front-Yard Setback Variance for a Non-Illuminated Monument
Sign for 1340 Mendota Heights Road as proposed in Planning Case #04-35 is hereby
approved based on the following considerations:
1. The variance is necessary in order to put the property to reasonable use because the
landscaping has grown tip during the years and has created sightlines that would not
permit visibility if there were a 40-ft. setback for the sign.
2. There are unique circumstances pertaining to the applicant's property not caused by
the owner that create a sufficient hardship to justify the variance.
3. The variance will not alter the essential character of the neighborhood because it has
been the City's practice to accommodate sign variances in this area; the majority of
them have been 20-ft.
BE IT FURTHER RESOLVED that the Front-Yard Setback Variance for a
Non-Illuminated Monument Sign for 1340 Mendota Heights Road as proposed in
Planning Case #04-35 would not have an adverse impact on the health, safety, and
general welfare of the citizens of the community and the surrounding land, and would not
be adverse to the general purpose and intent of the Zoning Ordinance.
