Res 2004- 68 Approving Variance @ 697 South Freeway RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04-68 A RESOLUTION APPROVING AN EIGHT-FOOT VARIANCE TO THE FRONT YARD SETBACK FROM OAK STREET FOR AN ATTACHED GARAGE AT 697 SOUTH FREEWAY ROAD WHEREAS, Mr. Dominic Alfonso has applied for an Eight-Foot Variance to the Front Yard Setback from Oak Street for an Attached Garage at 697 South Freeway Road [Lot 8 Block 3 Jefferson Heights, PIN=27-36800-080-03] as proposed in Planning Case #04-36; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on August 24, 2004; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Eight-Foot Variance to the Front Yard Setback from Oak Street for an Attached Garage as presented to the Planning Commission on the evening of August 24, 2004 and as shown in Planning Case #04-36, NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that an Eight-Foot Variance to the Front Yard Setback from Oak Street for an Attached Garage for 697 South Freeway Road as proposed in Planning Case #04-36 is hereby approved. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that this Eight-Foot Variance to the Front Yard Setback from Oak Street for an Attached Garage at 697 South Freeway Road as proposed in Planning Case #04-36 is hereby approved based on the following considerations: 1. The variance is necessary in order to put the property to reasonable because the ordinance requires single-family homes to have a two-car garage and there is not enough room to build this garage without needing a variance as the proposed garage would encroach into the 30-ft. setback. 2. There are unique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the variance. 3. The variance will not alter the essential character of the neighborhood. BE IT FURTHER RESOLVED that the Eight -Foot Variance to the Front Yard Setback from Oak Street for an Attached Garage Expansion for 697 South Freeway Road as proposed in Planning Case #04-36 would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
