Res 2004- 78 Approving CUP, Wetlands Permit @ 1416 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04-78 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT, WETLANDS PERMIT, VARIANCES FOR NUMBER AND SIZE OF ACCESSORY STRUTURES, A TWO-FOOT HEIGHT VARIANCE FOR AN ACCESSORY STRUCTURE, AND VARIANCE FOR PARKING LOT SETBACK TO REPLACE ONE ACCESSORY STRUCTURE AND EXPAND ANOTHER ACCESSORY STRUCTURE AT 1416 DODD ROAD WHEREAS, Somerset Country Club has applied for a Conditional Use Permit, Wetlands Permit, Variances for Number and Size of Accessory Structures, a two-foot Height Variance for an Accessory Structure, and Variance for Parking Lot Setback to Replace One Accessory Structure and Expand Another Accessory Structure at 1416 Dodd Road [Lots 52 and 54 Auditors Subdivision 43 (PID #27-03800-010-54)] as proposed in Planning Case #04-41; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 28, 2004; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit for the accessory buildings, the wetlands permit for parking lot improvements, and the variances to the maxim-Lun number and size of accessory structures and parking lot setback, as presented to the Planning Commission on the evening of September 28, 2004 and as shown in Planning Case #04-41, but to deny the variance for maximum height of an accessory structure. The Planning Commission also recommended a condition that evergreen shrub plantings be added to fully screen the parking area from the residential neighborhood to the north. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that the Council approves the Conditional Use Permit, Wetlands Permit, Variances for N-umber and Size of Accessory Structures, a two-foot Height Variance for an Accessory Structure, and Variance for Parking Lot Setback to Replace One Accessory Structure and Expand Another Accessory Structure at 1416 Dodd Road as presented to the Council on October 5, 2004 and proposed in Planning Case #04-41. The approval is based on the following conditions: 1. Arborvitae plantings shall be added to fully screen the parking area as well as the building from the residential neighborhood to the north. 2. Any demolition shall comply with all applicable, federal, state, and local regulations. BE IT FURTHER RESOLVED by the City Council of the City of Mendota Heights that the Variances for number and size of accessory structures and parking lot setback are hereby approved based on the following considerations: 1. The variances are necessary in order to put the property to reasonable use. 2. There are unique circumstances pertaining to the applicant's property not caused by the owner that create a sufficient hardship to justify the variances. 3. The variances will not alter the essential character of the neighborhood. BE IT FURTHER RESOLVED that the Conditional Use Permit, Wetlands Permit, and approved Variances To Replace One Accessory Structure and Expand Another Accessory Structure for 1416 Dodd Road as proposed in Planning Case #04-41 under the above condition would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surro-Lmding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
