Res 2004- 85 Approving CUP @ 2020 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04 -85 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR A CASH BOOTH AND CUSTOMER ORDER DISPLAY STAND FOR MCDONALD'S RESTAURANT AT 2020 DODD ROAD WHEREAS, Ms. Jane McKay of McDonald's Restaurant has applied for a Conditional Use Permit Amendment for a Cash Booth and Customer Order Display Stand at 2020 Dodd Road [Legal Description] as proposed in Planning Case #04 -42; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on October 26, 2004; and WHEREAS, The Planning Commission voted to recommend that the Council approve the Conditional Use Permit Amendment for a Cash Booth and Customer Order Display Stand as presented to the Planning Commission on the evening of October 26, 2004 and as shown in Planning Case #04 -42 under certain conditions. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Mendota Heights that the Council approves the Conditional Use Permit Amendment for a Cash Booth and Customer Order Display Stand, as presented to the Council on the evening of November 2, 2004 and as shown in Planning Case #04 -42 on the following conditions: a. The materials and colors of the cash booth addition shall be consistent with those of the existing building. b. The submitted site plan shall be modified to illustrate the proposed customer order display stand location. c. The site plan shall be modified to illustrate the location of the existing cash booth and specify any restoration of the site following removal. d. The applicant shall provide a landscape plan to the City by February 21, 2005 for review by the City Council at their regular meeting on March 1, 2005. This landscape plan shall either restore the landscaping of the McDonald's restaurant site in accordance with the landscape plan submitted by McDonalds dated 6/8/78 on file at the City in Planning Case File #75 -16, or provide alternative landscaping which achieves adequate screening. This landscape plan shall include restoration of the area of the cash booth after it is removed. Upon Council approval of a landscape plan, the applicant shall be required to implement and maintain the landscape plan. BE IT FURTHER RESOLVED that the Conditional Use Permit Amendment for a Cash Booth and Customer Order Display Stand for 2020 Dodd Road as proposed in Planning Case #04-42 under the above conditions would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
