Res 2004- 86 Approving Amendment to CUP @ 1416 Dodd RdCITY OF MENDOTA HEIGHTS DAKOTA COUNTY, MINNESOTA RESOLUTION 04 -86 A RESOLUTION APPROVING A MANOR AMENDMENT TO THE CONDITIONAL USE PERMIT TO REPLACE ONE ACCESSORY STRUCTURE AND ADD ANOTHER ACCESSORY STRUCTURE AT 1416 DODD ROAD WHEREAS, Somerset Country Club had applied for a Conditional Use Permit, Wetlands Permit, and Variances to replace one accessory structure and expand another accessory structure at 1416 Dodd Road [Legal Description] as proposed in Planning Case #04 -41; and WHEREAS, The Planning Commission held a public hearing on this application at their regular meeting on September 28, 2004; and WHEREAS, the City Council of the City of Mendota Heights approved the Conditional Use Permit for the accessory buildings, the wetlands permit for parking lot improvements, and the variances to the maximum number and size of accessory structures and parking lot setback, as presented to the Council on the evening of October 5, 2004 and as shown in Planning Case #04- 41, but denied the variance for maximum height of an accessory structure. The approval was based on the following conditions: 1. Arborvitae plantings shall be added to fully screen the parking area as well as the building from the residential neighborhood to the north. 2. Any demolition shall comply with all applicable, federal, state, and local regulations. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mendota Heights that the Council hereby approves a Minor Amendment to the Conditional Use Permit to add an accessory building rather than expand the existing building, as presented to the Council on the evening of November 2, 2004. BE IT FURTHER RESOLVED that this Minor Amendment to the Conditional Use Permit to replace one Accessory Structure and add another Accessory Structure for 1416 Dodd Road would not have an adverse impact on the health, safety, and general welfare of the citizens of the community and the surrounding land, and would not be adverse to the general purpose and intent of the Zoning Ordinance.
