RESOLUTION 04-97
A RESOLUTION APPROVING A SUBDIVISION
AND MINOR PUD AMENDMENT FOR A LOT LINE ADJUSTMENT
FOR DAVID NEWCOMB AT 1565 DODD ROAD
WHEREAS, David Newcomb have applied for a Subdivision and Minor PUD
Amendment for a Lot Line Adjustment at 1565 Dodd Road [Lot 3, Block 4, T. T. Smith's
Subdivision No. 2, Dakota County, Minnesota] as proposed in Planning Case #04-48; and
WHEREAS, The Planning Commission held a public hearing on this application
at their regular meeting on November 23, 2004; and
WHEREAS, The Planning Commission voted to recommend that the Council
approve the Subdivision and Minor PUD Amendment for a Lot Line Adjustment as
presented to the Planning Commission on the evening of November 23, 2004 and as
shown in Planning Case #04-48 under certain conditions.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the
City of Mendota Heights that the Council approves the Subdivision and Minor PUD
Amendment for a Lot Line Adjustment, as presented to the Council on the evening of
December 7, 2004 and as shown in Planning Case #04-48 on the following conditions:
1. The applicant shall provide written verification of the subdivision to the City after
it is filed at Dakota County, including verification that the subdivided parcel was
immediately recombined with the adjacent property to the north.
2. The City Engineer shall provide comment and recommendation in regard to the
need to vacate/re-establish drainage and utility easements.
3. The City Engineer shall provide comment in regard to grading and drainage
issues.
4. Consideration shall be given to slightly reconfiguring the driveway of the single-
family home to provide a 90-degree alignment with Dodd Road (to improve
vehicle sight lines and safety).
5. If a subdivision is approved, applicable zoning designation boundaries of the two
parcels of land in question shall be modified to reflect the lot line adjustment.
6. The applicant shall cause a Covenant of Payment of Taxes, similar in form to the
example attached and acceptable in form to the City Attorney, as evidenced in
writing, to be recorded against the newly created and existing parcels.
BE IT FURTHER RESOLVED that this Subdivision and Minor PUD
Amendment for a Lot Line Adjustment for 1565 Dodd Road as proposed in Planning
Case #04-48 under the above conditions would not have an adverse impact on the health,
safety, and general welfare of the citizens of the community and the surrounding land,
and would not be adverse to the general purpose and intent of the Zoning Ordinance.
